Terms of purchase

1. General

The following constitute an agreement between you and Ocean King (ABN: 23 081 730 494) (“Ocean King”, “we” or “us”), the operator of the Ocean King website www.Ocean King.com.au(“the Site”), in relation to the purchase of goods via the Site. 


By purchasing goods via this Site, you signify that you agree to these Terms of Purchase, and you consent to resolve in the State of Victoria, Australia any dispute that you may have with us, the Site, or any purchase or attempted purchase of goods or services by you via the Site.

2. Changes to these Terms of Purchase

We may change these Terms of Purchase at any time, as we deem appropriate. We encourage you to review the Terms of Purchase regularly, including before each purchase made via the Site.

3. Ordering goods

The range of goods offered over the internet directly from Ocean King is sourced from Ocean King’ Australian & New Zealand range of products (products sold in stores in other countries may differ from this range). Any order placed by you in the manner described on this Site is an offer by you to purchase a particular product at the advertised price (including delivery costs and other charges) specified on this Site at the time you place your order.

Orders are only accepted online and while stock lasts. You acknowledge that, by placing your order, you are agreeing to pay for and accept delivery of the goods ordered.

Ocean King may change the prices published on this Site at any time. Prices of products placed in the ‘shopping cart’ but not paid for are also subject to change and you agree to pay the price current at the time of payment.

While every effort has been made to ensure the accuracy of prices and information displayed on the Site and related website pages, Ocean King reserves the right to accept or reject your payment offer for any reason, including without limitation, the unavailability of any product, an error in the price or the product description posted on the Site, or an error in your order, or we reasonably believe you have not complied with these Terms of Purchase or the Additional Terms, or we have previously refused to accept any order(s) from you.

We are not responsible for typographical or photographic errors on this website, including any such errors in relation to prices.

4. About our prices

Product prices may vary between Australian retail stores and Ocean King’ website due to different retailer offers. Prices displayed on this website are current at the time of issue but may change at any time and are subject to availability. Prices and availability of items are subject to change without notice. Products are sold for personal use only.

5. Ocean King payments

Payments can be made by Visa, Mastercard, American Express, PayPal, Alipay, WeChat Pay and Dogecoin. Payment methods can be updated from time to time. Unless otherwise specified, the price payable for goods ordered is the price specified on this Site, plus any applicable shipping and handling charges.

Dogecoin exchange rate
While the exchange rate of Dogecoin to Australian dollar is used according to market rate, we reserve the right to decide the exchange rate.

6. Delivery

Each purchase will be shipped as a separate order and cannot be combined. Whenever possible in Australia, Sydney, Melbourne and Brisbane orders will usually be delivered around 5 days of ordering. Adelaide, Hobart, Perth and all regional areas around 7 days. Ocean King cannot guarantee delivery times, including due to reasons beyond Ocean King control. All deliveries are made Monday – Friday via Australia Post or other courier companies.

Post within Australia:
For purchases over AU$70.00 standard delivery is currently free in Australia. For purchases under AU$70.00, a flat delivery fee of AU$20.00 currently applies for standard delivery.

Post outside Australia:
For purchases over AU$300.00 standard delivery is currently free to all international deliveries outside Australia. For purchases under AU$300.00, a flat delivery fee of AU$30.00 currently applies for standard delivery.

For international orders deliveries are sorted and shipped via air freight to the handling centre within your country and then delivered by your country’s postal service. You agree that Ocean King is not responsible for, and has no control over, the local postal service in your country. You agree that Ocean King cannot be held liable for any shipping issues, delays or errors originating from within your country.

When ordering from Ocean King, the recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders that are shipped to countries outside of Australia may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by the recipient; Ocean King has no control over these charges and cannot predict what they might be. Customs policies vary widely from country to country and region to region; you should contact your local customs office for further information. When customs clearance procedures are required, it can cause delays beyond our original shipment delivery estimates.

Ocean King reserves the right not to deliver goods to certain countries. Ocean King is also not responsible for assuring the product can be lawfully imported to the destination country. When ordering from Ocean King, for delivery outside Australia, you or the recipient of record must comply with all laws and regulations of the destination country. Accordingly, you should check any import laws or regulations that would restrict the importation of the goods prior to purchase.

7. Returns & Return policy

We are not required to provide a refund or replacement if you simply change your mind after purchase, or delivery rejected by destination countries.

But you can choose a refund or exchange if an item has a quality problem. You have 14 calendar days to notify us of the quality issue and provide relevant evidence by email from the date you received it.

Once we receive your claim, we will inspect and notify you that we have received your claim. If the item is found to have quality issue, we will send out a replacement item for free no later than 7 days from the date we receive your claim.

Refunds

If you have received an item which has confirmed a quality problem and you do not want a replacement, we are happy to issue a full refund to you.

All refund payments will be processed in Australian Dollars (except for Dogecoin) and Ocean King will not be held liable for any difference in the value of the refund against the initial purchase price in the final currency you used to purchase the products. Ocean King will not be liable to refund any fees or charges you incurred from your credit/debit card provider for your initial purchase.

Note: For Dogecoin refund there will incur 5% transaction fee.

8. Safe arrival

All products are boxed using protective cushioning for safe arrival. If there is any damage to the package content – please ensure you include the order number. We may request that you provide us with a picture of the damaged goods.

9. Title and risk

Title to the goods purchased on this Site does not pass from Ocean King to you until we have received payment in full for the goods.

10. Disclaimer of warranty

Ocean King is providing this Site and its contents on an ‘as is’ basis and use of this website is at your own risk. The content is believed to be accurate, complete, current and reliable at the date the information was placed on the website. Ocean King and its related companies, affiliates, licensors or licensees, and their respective directors, officers, employees or agents make no representation or warranty as to the accuracy, completeness, currency or reliability of the information contained on this Site (including in relation to any products or services). To the extent permitted by law, including any non-excusable statutory obligations (including under the Australian Consumer Law), none of them will be liable or responsible in any way (including in negligence) for errors in, or omissions from, the information contained on this Site. To the extent permitted by law, Ocean King expressly disclaims all warranties of any kind, whether express or implied, including (without limitation) implied warranties or conditions of merchantability or fitness for purpose.

11. Termination

Your ability to purchase goods from this Site may be terminated by Ocean King at any time without notice. All restrictions, licenses granted by you and limitations of Ocean King’ liability will survive termination.
